OLAPLEX Holiday Trip Sweepstakes Official Rules

NO PURCHASE NECESSARY. No purchase or payment of any kind is necessary to enter or win the  Olaplex Holiday Trip Sweepstakes (the “Sweepstakes”). A purchase will not improve your chances of winning.  Void where prohibited or restricted by law.

To Enter

During the Entry Period (defined below), either: (1) register for the Olaplex Pro Loyalty Program (via www.pro.olaplex.com or by contacting Olaplex Customer Service), and earn Tier 4 or Tier 5 rewards during the Entry Period to automatically be enrolled in the Sweepstakes; or (2) go to https://olaplex.com/pages/pro-loyalty-program (“Entry Site”) and complete the entire online entry form. Entries originating at any other Internet web site, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for the Sweepstakes. The use of any device to automate the entry process is prohibited. Only (1) entry per person. Duplicate entries for a single individual will be disqualified.   

Prize (1)

There will be one (1) prize winner selected via a random drawing from all eligible entries received during the Entry Period.  The winner will receive the following prize: a trip for winner and one (1) travel companion to Hawaii, inclusive of standard hotel room (double occupancy) for five (5) days and four (4) nights; three (3) meals a day while in Hawaii; economy class, roundtrip flight from an international airport closest to winner’s residence; transportation to/from hotel in Hawaii; and participation in a training and welcome dinner with Olaplex’s Advocate and Education team. Trip will occur on January 20, 2022 through January 25, 2022. ARV of prize: $5,000.00.  Winner and winner’s travel companion must show proof of full COVID-19 vaccination prior to trip. The specifics of all aforementioned elements of the prize in this Sweepstakes shall be solely determined by the Sponsor. All costs, taxes, fees, and expenses associated with any element of the prize not specifically addressed above are the sole responsibility of the winner. All federal, state and local taxes on the prize are the prize winner’s responsibility. Prize winner will be issued a 1099 tax form for the actual value of the prize.

Travel must be roundtrip. Sponsor will determine airline, flight itinerary, and hotel accommodations in its sole discretion. If, in the judgment of Sponsor, air travel is not required due to winner's proximity to destination, ground transportation will be substituted for roundtrip air travel at Sponsor's sole and absolute discretion. The difference in value will not be awarded to the prize winner. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract.  Winners will not receive difference between actual and ARV of the prize. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize (or a component thereof) for one of equal or greater value if the designated prize should become unavailable for any reason.  All travel dates will be determined by the Sponsor, and may not be altered except by the Sponsor. If winner cannot travel on the dates designated by Sponsor, prize will be forfeited and an alternate winner will be selected (time pending). Some restrictions may apply. Meals not described above, incidentals, tips, telephone calls, or any other personal expenses incurred during the trip are the responsibility of the winner. All other expenses not specifically identified as included in the prize are the sole responsibility of the winner. Winner and travel companion are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Winner and travel companion must travel the same itinerary and on the dates and/or times specified by Sponsor or prize will be forfeited in its entirety. Once the travel companion is selected, he/she may not be substituted, except at the Sponsor’s sole discretion. Winner and travel companion are solely responsible for obtaining any identification documents necessary for domestic travel. Travel companion of winner must be at least twenty-one (21) years old, and must sign a Liability and Publicity Release. If potential winner’s travel companion fails to return such documents within date and/or time indicated within such documents, then the potential winner may forfeit the right to the travel companion. Winner will be required to provide a credit card at hotel check-in for incidental expenses.

Odds

The odds of winning a prize are determined by the total number of eligible entries received. The prize is awarded "as is" with no guarantee, either express or implied. If by reason of a printing, typographical, or other error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded.

Eligibility

This Sweepstakes is open only to licensed cosmetologists, who are legal residents of the fifty (50) United States (and its territories and possessions), who are twenty-one (21) years of age or older as of the date of entry and who meet the eligibility requirements. The officers, directors, employees, contractors, and agents of the Sponsor and the Promotion Entities and the immediate families and those living in the same household of any of the above, are not eligible to participate in the Sweepstakes. All Federal, state and local rules and regulations apply. Void where prohibited or restricted by law.

Entry Period

This Sweepstakes starts on January 1, 2021, at approximately 12:01 AM ET and ends on December 31, 2021 at approximately 11:59 PM ET (the "Entry Period"). All entries must be received by the end of the Entry Period to be valid. The sponsor of this Sweepstakes is Olaplex, Inc., 1187 Coast Village Road #1-520, Santa Barbara, California 93108, USA (the "Sponsor"). This Sweepstakes shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein.

Winner Selection

One (1) winner will be selected by random drawing from among all eligible entries on or about January 3, 2022 and will be notified on or about January 4, 2022 via e-mail sent to the e-mail address used at the time of registration for this Sweepstakes. Once contacted, the winner will have forty-eight (48) hours to respond to the notification. Winner will be required to sign an Affidavit of Eligibility and Liability and Publicity release (where permitted), and return same, properly executed, within forty-eight (48) hours of issuance of prize notification. If winner fails to respond to the e-mail message within forty-eight (48) hours or to comply with any of the requirements or other provisions may result in the winner being disqualified and an alternate winner selected (time pending). If a prize notification or a prize is returned as undeliverable for any reason, the applicable prize will be awarded to an alternate winner (time pending). Prize is not transferable, assignable, or redeemable for cash. Decisions of Sponsor with respect to winner and other matters pertaining to the Sweepstakes shall be final. All Federal, state and local tax liabilities are the responsibility of the winner.  

General

Entrants release and waive any claims they may have against Releasee for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney's fees) resulting from acceptance, use, or misuse of any prize or parts thereof, or participation in this Sweepstakes. If for any reason, this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of this Sweepstakes and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor's sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled, the Sponsor reserves the right to conduct a random drawing to award all remaining prizes from among all eligible, non-suspect online entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification, or suspension occurs, notification will be posted at the Entry Site. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of this Sweepstakes is a violation of criminal and/or civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Where a dispute arises about who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email account entered. The authorized account holder is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met. 

The Sponsor and any and all distributors of Olaplex, Internet server(s) and access provider(s) (collectively, "Promotion Entities"), and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively with the Promotion Entities, the "Releasees") are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes; inability to access the Entry Site; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including the Entry Site) or for any other reason whatsoever; printing or other errors; any entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible, or any combination thereof.

Incorrect and/or incomplete entries will be disqualified. All entries become the property of the Sponsor and will not be acknowledged or returned. Except where prohibited by law, the winner's entry and acceptance of the prize constitutes permission for the Sponsor to use said winner's and any travel companion’s names, photographs, likenesses, statements, biographical information, voices, and city and state addresses on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. No more than the advertised number of prizes will be awarded.  Entrants understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Entrants further acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”  The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

False, fraudulent or deceptive entries or acts shall render entrants ineligible. By entering this Sweepstakes, entrants affirm that they have read and accepted these Official Rules. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of any entrant or the Sponsor in connection with this Sweepstakes, shall be governed by and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the State of California. Any action or litigation concerning this Sweepstakes shall take place exclusively in the federal or state courts sitting in California, and entrants expressly consent to the jurisdiction of and venue in such courts and waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. Entrants agree to service of process by mail or other method acceptable under the laws of the State of California. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANTS HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY'S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.

If winner and/or winner’s travel companion has engaged in behavior that is obnoxious, threatening, disruptive, inappropriate, illegal, or acts with the intent to annoy, abuse, threaten, or harass any other person, as determined by Sponsor in its sole discretion, Sponsor reserves the right to disqualify winner and to immediately terminate any outstanding portion of the prize without further compensation.

Privacy

Any entry information collected from this Sweepstakes shall be used only in a manner consistent with the consent given by entrants at the time of the entry, with these Official Rules and with the Sponsor’s Privacy Policy https://olaplex.com/pages/privacy.
