Celebrate OLAPLEX in NYFW SS2023 Sweepstakes

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. 

ELIGIBILITY:  The Celebrate OLAPLEX in NYFW SS2023 Sweepstakes (the "Sweepstakes") is open to legal residents of the United States and Canada (excluding Rhode Island and Quebec) who are: (1) licensed stylists or salon owners, and (2) 18 years of age or older.   Employees, officers or directors of Olaplex, Inc. (“Sponsor”), or any of its parents, subsidiaries, affiliates, or any advertising or promotion agencies involved in this Sweepstakes (collectively, the “Sweepstakes Entities”), as well as the immediate family and household members of each such person, are not eligible to participate. All applicable federal, state and local laws apply. By participating, you agree to be bound by these Official Rules. Void in Rhode Island and Quebec where prohibited.

SWEEPSTAKES PERIOD:  The Sweepstakes begins on 8/25/2022 at 12:00:01 a.m. Eastern Time (“ET”) and ends on 8/30/2022 at 11:59:59 p.m. ET (the “Sweepstakes Period”).  The Sponsor’s database computer is the official time-keeping device for this Sweepstakes. 

HOW TO ENTER: During the Sweepstakes Period, login to Instagram and upload/post an original photo showing an original hairstyle that you created by same stylist that is inspired by New York Fashion Week (“Post”) on your public Instagram feed. Your Post must include the hashtags #WHYILOVEOLAPLEX and #OLAPLEXNYFWSWEEPSTAKES and tag @Olaplex. Only Posts with both hashtags can be counted as entries. Your Instagram account must be set to "public" so the judges can see your photo.  

Limit one (1) entry per person/Instagram account, regardless of number of Posts. Any attempt to enter more than one (1) time via multiple names, email addresses, Instagram accounts, or any other means, may result in disqualification from this and any other promotional offerings from Sponsor.  Use of any macro, bot, script or other automated means to submit entries is prohibited. Proof of posting is not proof of accessibility of the posting to Sponsor or anyone else. Entries will not be acknowledged or returned. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the email address associated with the Instagram account used to post the entry. "Authorized account holder" is defined as the natural person who is assigned to an email address or other similar account associated with the relevant Instagram account.

ENTRY REQUIREMENTS:  In addition to the above, all photos and Posts must: (a) be the exclusive original work of the entrant; (b) be in keeping with the Sponsor’s image, (c) not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy or publicity, (d) not contain any commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans other than the Sponsor's, (e) not depict any conduct or content that is unsafe, immoral, obscene or otherwise inappropriate as determined by Sponsor in its sole and absolute discretion; and (f) not have been submitted in any other promotion or won any prize. 

Each entrant represents and warrants that he/she has obtained permission from any and all recognizable persons other than the entrant depicted or mentioned in a Post and agrees, upon request, to furnish written proof of such permission.  Failure to meet any of the requirements above, or to otherwise comply with these Official Rules, may result in disqualification.  Sponsor reserves the right to delete or blur any inappropriate content from a submission without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the submission and the entrant has otherwise attempted in good faith to comply with these Official Rules.

PUBLICITY/USAGE RIGHTS: By entering, you warrant and represent that your photo has been created by you as an original work and that all required third-party releases (if any) have been obtained in writing, and you further agree acknowledge and agree that Sponsor (and those acting with its authorization) may copy, reproduce, edit, broadcast and otherwise use your submission in any way in any medium whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting online on Sponsor’s social media pages.   Sponsor reserves the right to remove or reject any content it deems inappropriate for any reason.  Except where prohibited, participation in the Sweepstakes and/or receipt or use of any prize further constitutes the winner’s consent for use of his/her Post name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law).

WINNER SELECTION AND NOTIFICATION:  The winner will be selected in a random drawing from among all eligible entries on or about 8/31/2022. Potential winner will be notified using the contact information provided at the time of entry.  No liability is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason.  Failure to respond to any winner notification within two (2) days may result in disqualification and selection of an alternate winner.  Each winner may be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release (where legal) (“Prize Claim Documents”). If any eligible winner is not of legal age of majority in his or her state of residence (a “minor”), at Sponsor’s option, the applicable prize either may be awarded in the name of parent or legal guardian of winner, or parent or legal guardian of winner may be required to ratify and sign all Prize Claim Documents. If a potential winner fails to comply with Sponsor’s requests for Prize Claim Documents, is found to be ineligible, or cannot or does not comply with these Official Rules, he/she may be disqualified and prize may be awarded to an alternate winner.

PRIZES/ODDS:  One (1) prize is available: A trip for one (1) person to New York City, NY to attend the Jason Wu show during New York Fashion Week currently scheduled to occur on September 10, 2022. Prize consists of: (a) round trip airline transportation (coach class) for winner between major U.S. airport nearest winner’s residence and New York City, NY, (b) hotel accommodations in New York City, NY at a hotel selected by Sponsor (consisting of one (1) double-occupancy, standard room) for three (3) days and two (2) nights, (c) standard admission for winner to the Jason Wu show during New York Fashion Week (“Event”), (d) ground transportation from New York City, NY airport to New York City, NY hotel and from New York City, NY hotel to New York City, NY airport, and (e) $200 gift card for incidental expenses. Approximate Retail Value (ARV): $1,600. Travel must be completed to coincide with the Event.

All transportation, lodging, meals, and other costs and expenses not otherwise identified herein are the responsibility of the winner. Ground transportation may be substituted for air transportation at Sponsor’s sole discretion if air travel is not required due to winner’s proximity to New York City, NY. Major credit card will be required at hotel check-in to cover any incidental expenses. Winner may be required to sign any Prize Claim Documents prior to ticketing.  Winner must have all ID and other documents necessary for travel, including but not limited to any required vaccination or proof of negative COVID-19 testing. If winner cannot travel on specified dates, an alternate winner may be selected. Event date is subject to change.  No responsibility is assumed for cancellation or postponement of Event beyond Sponsor’s control. If Event is cancelled or postponed after travel arrangements are made, remainder of trip will be awarded as the complete prize.

Prize is non-transferable and no cash equivalent or substitution of the prize is offered, except at the sole discretion of the Sponsor. Sponsor may substitute a prize of comparable value if advertised prize becomes unavailable.   Each winner is responsible for all federal, state and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize.

Odds:  The odds of winning depend on the number of eligible entries.

PRIZE CONDITIONS:  Sponsor may conduct a background check to confirm eligibility and compliance with these rules.  By entering, you agree to cooperate reasonably with any such background check.  Failure to cooperate may result in disqualification and selection of an alternate winner.  If a potential winner or potential guest has engaged in or does engage in any conduct that could damage the reputation or business of Sponsor, as determined by Sponsor in its discretion, the potential winner may be disqualified and the prize may be awarded to an alternate winner, time permitting.   Each potential winner and potential guest must also comply with all requirements for proper and appropriate behavior during any prize-related activities or events, including but not limited to the Event. Any inappropriate behavior, as determined by Sponsor in its sole discretion, may result in removal from any activity or event.

ADDITIONAL RULES:   Entry materials/data that have been tampered with or altered are void. No responsibility is assumed for: (i) lost, late, misdirected, damaged, garbled, incomplete or illegible entries, all of which are void; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, mobile device, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems; or (iii) any injury or damage to entrant's or any other person's computer or mobile device related to or resulting from participating in the Sweepstakes.

By participating, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the judges, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Official Rules; and (ii) suspend, modify or terminate the Sweepstakes if Sponsor believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper conduct of the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner from all eligible, non-suspect entries unaffected by the problem. 

RELEASE OF LIABILITY:  By participating, you (and if you are a minor, your parent or legal guardian) release Sponsor, Instagram, and each of their respective parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of this Sweepstakes from any and against  any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize except as expressly provided in these Official Rules.  By participating, you agree that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (d) these Official Rules and all disputes shall be governed by the internal laws of the state of California, without regard to principles of conflicts of laws, any disputes shall be resolved exclusively in the state or federal courts in the state of California, and you expressly consent to the jurisdiction of said courts and waive any objection thereto.  For New Jersey Residents:  Nothing herein prohibits recovery of damages or attorneys’ fees where required by statute.

WINNER NAME:  For the name of the winner, available approximately two weeks after the end of the Sweepstakes send an email to [email protected].  Be sure to include “Celebrate OLAPLEX in NYFW SS2023 Sweepstakes” in the subject line of your email. All such requests must be received within 60 days after the Sweepstakes.

INSTAGRAM: By participating, you release Instagram, and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize.  This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram. 

FOR CANADA ONLY:  Any potential winner from Canada must answer a time-limited mathematical skill-testing question without assistance of any kind, whether mechanical or otherwise, to be administered by telephone at a time specified by Sponsor.  Failure to answer skill-testing question correctly in the time provided will result in disqualification and selection of an alternate winner, at Sponsor’s sole discretion.  Personally identifiable information you submit in connection with the Sweepstakes will be collected, used and disclosed only for the purposes of administering the Sweepstakes, prize fulfillment, as you otherwise expressly consent or as required by law. By entering the Sweepstakes, you consent to such collection, use and disclosure.
